These Terms are a contract between you and Endless Health, Inc. d/b/a Endless Heart (“Company,” “we,” or “us”; formerly Peregrine Biosense Inc.) for access to and use of the Endless Heart mobile application and related services.

Acceptance of Terms

By clicking “I Accept,” or by downloading, installing, or using the App or Services, you confirm you have read and agree to these Terms, including arbitration provisions and our Privacy Policy. If you do not agree, you may not use the Services.These Terms are effective when you first use or access the Services and continue until terminated. Surviving provisions remain in effect after termination.

Health disclaimer

The Company is not a healthcare provider and does not offer medical advice or services. Content in the App is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider about medical questions.

Subscription disclaimer

If you subscribe, your subscription continues for the term you purchase and auto-renews for matching periods at then-current fees unless you cancel or opt out of renewal. Ending your account does not cancel a subscription. Cancel per the subscription section below or by contacting help@endlessdx.com.

Arbitration notice

The Arbitration section below explains how claims are resolved. Unless you opt out: (1) you may only pursue claims on an individual basis, not as part of a class; and (2) to the extent permitted by law, you waive jury trial and court proceedings for covered claims.

Overview & product offering

Endless Heart helps you understand your health through our mobile app, health testing kits, educational content, and related online services. Offerings may include:
‍Mobile App: Health information, tools, and (where available) AI-based coaching and wearable connections.
‍Health testing kits: Insights into health markers; informational only — not a substitute for medical care.
‍Online services: Forums, webinars, or workshops when available.
‍Subscriptions: Access to premium content or services when offered.
We do not replace healthcare providers. Always seek professional care for medical concerns.

Test services

Specimens submitted for testing must be accompanied by a valid order from an authorized healthcare provider. You are responsible for required consents. Results may be reported to authorized providers and, with appropriate authorization, to you through the App.

Services are for users 18 or older. By using the Services, you represent that you meet this requirement.

Account creation & maintenance

To use certain features you must register an account, provide accurate information (such as name, email, date of birth, and other details we request), accept these Terms, and consent to our Privacy Policy.

You are responsible for your account activity and for keeping credentials secure. Do not share your account. Report unauthorized use promptly. You do not own a property interest in your account; rights in the account remain with the Company.

Rules for service use

You agree not to, among other things:
Commercially exploit the Services without permission.
Frame or reverse engineer the Services.
Spam, impersonate others, or act fraudulently.
Upload malware or harvest personal information.
Interfere with or bypass access controls.
Use the Services to build competing products.
We may modify, suspend, or terminate access at our discretion, including for Terms violations.

License & mobile app use

We grant a revocable, limited, non-exclusive, non-transferable license to use the App and Services for personal purposes under these Terms. This is not a sale of the App; all rights remain with the Company and its licensors. Device compatibility and upgrades may be required.

Privacy & confidentiality

Information we collect is handled under our Privacy Policy. By using the App, you consent to that handling.

Term, termination & changes

These Terms begin when you first use the Services and continue until terminated. We may suspend or end access at any time. You may stop using the Services and contact support to end the agreement. On termination, your right to use the Services ends immediately; certain sections survive.We may change or discontinue features. Keep copies of any content you need, as access may be lost after changes or termination.We grant a revocable, limited, non-exclusive, non-transferable license to use the App and Services for personal purposes under these Terms. This is not a sale of the App; all rights remain with the Company and its licensors. Device compatibility and upgrades may be required.When we change this policy, we will post updates in the App (and may note the update elsewhere as appropriate). The date of the latest revision will be identified. Please keep your email current and review this policy periodically.

Intellectual property

Except for your user content, the Company owns the App, Services, and related IP (software, text, graphics, logos, trademarks, and more). Unauthorized use is prohibited. You receive only a limited personal license as described above.

Feedback you share may be used by the Company without restriction or compensation.

Paid services & subscriptions

Some features may require payment. You agree to pay applicable fees. Payments are processed by third-party processors; you authorize charges to your payment method.

Subscriptions bill at purchase and renew until canceled. Cancel via account settings (when available) or support@endlessheart.org. After cancellation, access continues until the end of the current term.

Order confirmation does not guarantee acceptance. Sales are subject to our return policy. Taxes may apply in addition to listed prices.

Third-party content & software

The App may link to third-party sites or services we do not control. Access them at your own risk; our Terms and Privacy Policy may not apply. Third-party software components may be subject to their own licenses.

Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, employees, and agents from claims and costs arising from your use of the Services, your content, your breach of these Terms, or violation of law or third-party rights.

Warranty disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee accuracy, reliability, or availability of content or results.

Limitations of liability

To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or similar damages. Aggregate liability shall not exceed one hundred U.S. dollars ($100), except where prohibited by law.

Prohibited behavior & user content

You must not use the Services for illegal activity, harassment, IP infringement, fraud, or interference with security or other users’ enjoyment.

You are responsible for User Content you submit and grant the Company a broad license to use it as needed to operate and improve the Services. We may remove content that violates these Terms. We are not obligated to store or pre-screen User Content.

Arbitration

Except for limited exceptions (small claims, certain agency actions, IP injunctions), disputes are resolved by binding individual arbitration under AAA Consumer Rules and the Federal Arbitration Act. Class actions are not permitted.

To opt out, send written notice within 30 days of agreeing to these Terms to Endless Health, Inc. with your name, email used for the Services, and a clear statement that you opt out of arbitration.

Before arbitration, send a Notice of Arbitration describing the claim and relief sought. Good-faith negotiation for 30 days is required first. Full procedures are as described in the complete Terms maintained by the Company.

Miscellaneous

These Terms (with the Privacy Policy and incorporated policies) are the entire agreement regarding the Services. Texas law governs. Courts in Texas have exclusive jurisdiction for non-arbitrable matters.
